TERMS OF SERVICE

BOOKING FEES

A deposit of £450 confirms your booking and is deductible from the package price with the balance due two weeks before the wedding date. Failure to pay the balance before the due date will be taken as an indication of cancellation of booking, with a loss of booking fee. Dates are reserved only when the booking fee is paid. Upon the signature of a booking agreement Sarah Elliott Photography reserves the date and will not make any other reservations. For this reason all booking fees are non – refundable, even if the date is changed or wedding cancelled for any reason.

CANCELLATION

In the event of a client cancelling a booking for wedding photography Sarah Elliott Photography reserves the right to charge a cancellation fee of 50% of the total agreed fee if cancelled less than ninety days prior to the wedding date.

PAYMENTS

Balance payment of package booked is due fourteen days before the date of the wedding. Payment of additional photographs and albums are made when these are ordered. Payments can be made by cheque, cash or BACS. Details are provided at the bottom of your invoice.

COPYRIGHT

The 1988 Copyright Act assigns the copyright to Sarah Elliott Photography. It is contrary to the Act and strictly illegal to copy or allow to be copied, any photographs covered by this contract. Sarah Elliott Photography grants the client permission to make copies of the images under the conditions that the images taken by Sarah Elliott Photography are for personal use by the client and their friends and relatives. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from Sarah Elliott Photography

Sarah Elliott Photography is granted the irrevocable and unrestricted right to use and publish photographs for editorial, trade, advertising or any other purpose and in any manner and/or medium considered standard by the wedding industry. Such mediums/purposes include, but are not limited to: advertising, internet promotion, photographic contests, public displays, photography books, wedding blogs, studio display, sample wedding albums, and any other use thought proper by Sarah Elliott Photography and considered standard by the wedding industry 

IMAGES

Images will be provided in an online gallery and will be provided within 2 months of the wedding date. All images created and captured by Sarah Elliott Photography shall remain the property of Sarah Elliott Photography who undertakes to store such images safely and make them available for a period of up to a year after the date of the wedding.

ALBUMS

The prices for album(s) orders are dependant on the final selection of images for the album(s) being chosen by the client no more than 6 months after the wedding date or the date that an album was commissioned. If the final image selection is late in being returned, Sarah Elliott Photography reserves the right to choose the final images for the album. If there is any reason to believe the final image selection will be unavoidably late, this must be discussed with Sarah Elliott Photography, who may be able to extend the date for the album selection to be returned.

ACT OF GOD

The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

WEATHER AND DELAYS

Weather permitting, images will be taken as agreed with the client. In the event of rain, snow or any form of weather disturbances, Sarah Elliott Photography will make the necessary changes to the photographic session and will not be responsible for any disappointment caused by the weather. However, Sarah Elliott Photography with the co-operation of the client will do their best to produce coverage of the wedding within the time allocated to them. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.

COVERAGE

Sarah Elliott Photography cannot be held responsible for restrictions placed by the marriage celebrant, church or venue. Nor can we be made responsible for a lack of coverage caused by members of the bridal party or guests being late or not available. Sarah Elliott Photography does not guarantee any specific image, location or background.

Sarah Elliott Photography shall be granted creative and artistic license in relation to the choice of locations and poses used. Judgement on photographic style and the number of photographs taken and delivered shall be deemed correct. On its own behalf, and on behalf of the subject, the client  acknowledges that they are familiar with Sarah Elliott Photography’s portfolio and are requesting services with knowledge of Sarah Elliott Photography’s style; that Sarah Elliott Photography’s work is constantly evolving; that Sarah Elliott Photography’s services are of unique and artistic nature; that the photos may be different from photographs taken by Sarah Elliott Photography in the past; and that in creating the photos, Sarah Elliott Photography shall use her personal artistic judgment to create images consistent with his personal vision of the event, which vision may be different from the client’s and the subject’s vision of the event. Accordingly, the client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria.

COLOUR MATCHING

The dyes used for clothing, particularly man-made fibres do not always photograph in the manner in which they appear to the eye. When the photographs are printed to produce a pleasing flesh colour some materials may appear incorrect. Sarah Elliott Photography will endeavour to achieve the closest possible colour match within the limitations of the materials and processes used.

EXCLUSIVITY

Sarah Elliott Photography shall be the sole professional (still) photographer(s) at the venues specified.

LIABILITY

In the unlikely event of total photographic failure, injury, sickness or cancellation of this contract by either party, liability should be limited to a full refund of all monies paid. Sarah Elliott Photography has full Public Liability and Professional Indemnity Insurance.
